Iraqi refugees after their arrival in Germany
"Persons persecuted on political grounds shall have the right of asylum", according to Article 16a of the Constitution of the Federal Republic of Germany, the 1949 Basic Law. Asylum law thus has a special priority in Germany.
In Germany, unlike many other countries, the right of asylum is not only anchored in the 1951 Geneva Convention on Refugees; it is also enshrined in the Constitution as a fundamental right. It is the only fundamental right which is applicable only to foreigners.
International mobility has greatly increased in recent years. This trend has also had an impact on immigration to Germany.
Many people have come to Germany from outside the EU to join family members, while others hope to find work or start a business here, and young people come to Germany to study or train for an occupation.

The Residence Act (AufenthG) governs the entry, residence, employment and termination of the residence of foreigners. In this way, it serves to control and limit the influx of foreigners into the Federal Republic of Germany.

New rules on the obligation to choose one citizenship went into effect on 20 December 2014.
Germany actively combats illegal entry and residence. This effort is closely related to the fight against illegal employment, as the hope of illegal employment increases the incentive to enter the country illegally.
